1. Introduction

CS Artworks provides creative and digital services including, but not limited to:

  • Website design and development
  • Website hosting
  • Graphic design
  • Branding and logo design
  • Social media management
  • Digital advertising
  • Print and digital media services

By engaging our services, you agree to these Terms & Conditions.

2. Quotations & Payments

  • All quotations provided by CS Artworks are valid for 14 days unless otherwise stated.
  • A non-refundable deposit may be required before work commences.
  • Final files, website launches, or deliverables may be withheld until full payment has been received.
  • Late payments may result in project delays, suspension of hosting/services, or additional fees.

3. Project Timelines

  • Estimated turnaround times are provided as guidelines and may vary depending on project scope and client feedback.
  • Delays caused by late content submission, revision requests, or client communication delays may affect delivery timelines.
  • CS Artworks will not be held responsible for delays caused by third-party platforms, hosting providers, or external services.

4. Client Responsibilities

Clients agree to:

  • Provide all required content, images, logos, and information needed for the project.
  • Ensure they have the legal right to use supplied content.
  • Review and approve work within a reasonable timeframe.

CS Artworks is not responsible for errors after client approval.

5. Revisions & Additional Work

  • Projects include a limited number of revisions unless otherwise agreed in writing.
  • Additional revisions or changes outside the agreed scope may incur extra charges.
  • Any new functionality or redesign requests after approval may be treated as a separate project.

6. Website Hosting & Domains

Where hosting services are provided:

  • Hosting fees are payable in advance.
  • Failure to renew hosting or domain services may result in suspension or permanent loss of the website/domain.
  • CS Artworks is not liable for downtime caused by hosting providers, server issues, or third-party services.

Clients remain responsible for maintaining valid domain registrations and renewals unless otherwise agreed.

7. Intellectual Property

  • Final approved work becomes the property of the client only after full payment has been received.
  • CS Artworks retains the right to display completed work in portfolios, marketing material, and social media unless agreed otherwise.
  • Any concepts, drafts, or rejected designs remain the property of CS Artworks.

8. Social Media & Advertising Services

For social media management and advertising services:

  • Results such as engagement, reach, sales, or follower growth cannot be guaranteed.
  • Advertising budgets paid to third-party platforms (e.g., Meta, Google, TikTok) are separate from management fees.
  • Clients are responsible for approving advertising content before campaigns go live.

9. SEO & Search Rankings

While CS Artworks may implement SEO best practices, we do not guarantee:

  • Specific Google rankings
  • Traffic increases
  • Sales conversions
  • Search engine placement

Search engine algorithms and policies are outside our control.

10. Limitation of Liability

CS Artworks shall not be liable for:

  • Loss of profits or revenue
  • Business interruption
  • Data loss
  • Third-party software failures
  • Cybersecurity incidents
  • Indirect or consequential damages

All services are provided on an “as is” basis.

11. Cancellations & Refunds

  • Deposits and completed work are non-refundable.
  • If a project is cancelled after work has commenced, the client may be billed for work already completed.
  • Monthly services may require written notice before cancellation.

12. Privacy

Any personal information submitted through the website will be handled responsibly and in accordance with applicable South African privacy laws, including POPIA where applicable.

13. Third-Party Services

CS Artworks may use third-party tools, plugins, hosting companies, or platforms. We are not responsible for:

  • Third-party outages
  • Software changes
  • Security vulnerabilities
  • Pricing changes imposed by external providers

14. Governing Law

These Terms & Conditions shall be governed by the laws of South Africa.

Any disputes arising shall be subject to the jurisdiction of South African courts.
